Terms of Service

These terms govern the website design, build and hosting services provided by demoin72 (“we”, “us”), operated by Phil Dukarsky, United Arab Emirates. You accept them by signing or approving a quotation, paying a deposit, or ticking the acceptance box at checkout — whichever happens first.

1. Our services

Build. We design and build your website based on the brief you complete for us. The build includes two rounds of revisions; further changes are quoted separately before we do them.

Hosting & care. Once you approve the site, we host and look after it for a monthly fee. This includes hosting, an SSL certificate, software updates, small content changes, and email support answered within one business day.

Not included unless quoted: new pages or redesigns, online-store functionality, copywriting beyond the brief, paid plugins or stock images, domain registration fees, and marketing or SEO campaigns.

2. Quotes and payment

Prices are as set out in your quotation or shown at checkout. Unless your quote says otherwise, the build fee is payable in full before work starts. The hosting fee is payable monthly in advance, starting at go-live. Payments are processed securely by Stripe.

If a payment is more than 14 days overdue we may suspend the site after giving you 7 days’ written notice, and will restore it once the account is settled. We may change the monthly fee with 30 days’ notice; if you do not accept the new price you may cancel before it takes effect.

3. What we need from you

Please provide your content (text, images, logo) and feedback promptly. If we are waiting on you for more than 14 days we may pause the project; after 60 days we may treat it as cancelled and invoice for work completed. You confirm that you own, or have permission to use, all materials you give us, and you are responsible for the accuracy and legality of the content published on your site.

4. Cancellation

Hosting runs month to month. Either of us may cancel with 30 days’ written notice (email is fine). On cancellation, once your account is fully paid, we will give you a complete copy of your website files and content within 14 days, plus reasonable help moving the site or repointing your domain. We delete the site from our hosting 30 days after handover.

5. Ownership

Once the build fee is paid in full, the website is yours — the design, the content and the site files. We keep ownership of our general-purpose tools, code libraries and know-how, and may reuse them for other clients. Your domain name is registered in your name and always belongs to you, including when we register it on your behalf. We may show the finished site in our portfolio and place a small “built by demoin72” credit in the footer, removed on request.

6. Third-party services

Your site depends on some third-party services (hosting infrastructure, domain registrars, plugins, payment providers). Their terms govern their services and we are not responsible for their outages, price changes or discontinuation, although we will do our best to work around any problems they cause.

7. What we don’t promise

We build good websites, but we cannot guarantee search-engine rankings, visitor numbers or sales, or that the site will be completely uninterrupted or error-free. We target at least 99.5% hosting uptime per month, excluding scheduled maintenance and third-party failures.

8. Liability

To the extent permitted by law, our total liability is capped at the fees you have paid us in the 12 months before the claim arose, and neither of us is liable to the other for indirect losses such as lost profits, lost data or lost business. Nothing in these terms excludes any liability that cannot be excluded under UAE law. You are responsible for claims arising from content you supply or publish on your site, except where caused by our own fault.

10. Changes to these terms

We may update these terms from time to time. Material changes will be notified to active clients at least 30 days before they take effect; the version on this page applies to new orders.

11. Governing law

These terms are governed by the laws of the United Arab Emirates. Any dispute we cannot resolve amicably will be referred to the courts of the UAE.
